Checking a customer for bankruptcy and court cases via API

Checking an individual or sole proprietor against courts and the bankruptcy register — before a loan, a lease, a rental or a management appointment. We search bankruptcy and arbitration by tax ID with no namesakes, and courts of general jurisdiction by full name, flagging exact matches.

EFRSB, the Arbitration Case Index, GAS Pravosudie: where to look for a person’s bankruptcy and court cases

A citizen’s bankruptcy and court history sit in three different systems, and none replaces another: out-of-court bankruptcy is not in the courts, and courts of general jurisdiction have no tax ID on their case cards.
We query all three in one run and return a separate line for each.

Tax ID versus full name: why we search bankruptcy by number and courts by name

The bankruptcy register and the Arbitration Case Index know a person’s tax ID; courts of general jurisdiction know only the full name. That determines how many namesakes come back.

  • Tax ID — no namesakes

Bankruptcy and arbitration we search by tax ID: EFRSB publishes it for every citizen-debtor.

A tax ID match — the same person.

    • EFRSB · KAD
  • Passport instead of tax ID

The system gets the tax ID from the passport — the customer does not need to know it.

Patronymic is required: without it the tax ID cannot be found.

    • Federal Tax Service
  • Full name and date of birth

EFRSB without a tax ID is checked by full name and date of birth.

For arbitration that is not enough — a tax ID is needed.

    • Federal bankruptcy register
  • Full name only — courts

Court of general jurisdiction cards contain no tax ID or date of birth.

Results are labelled: an exact match of the full name or a probable namesake.

    • GAS Pravosudie
  • Sole proprietor — by personal tax ID

A sole proprietor’s tax ID is their personal tax ID: every check on this page runs on it.

It does not replace the company check: a legal entity is covered in counterparty checks.

    • Sole trader
  • A foreign customer

From passport to a line in the file: three steps of a bankruptcy check

The check is launched by your system or your lawyer. The customer does not have to do anything if the passport or tax ID is already in the application.

Step 1

Passport or tax ID from the application

Full name, passport or tax ID are taken from a leasing application, a candidate form or a customer card. If there is no document, the customer photographs the passport in a KYC session.

A leasing application with passport data before the bankruptcy check
Step 2

Tax ID — and three sources at once

From the passport the system gets the tax ID and in one run queries EFRSB, the Arbitration Case Index and courts of general jurisdiction. The result is fetched by run number.

Tax ID from the passport and a request to three sources
Step 3

A line for each source

For each check — whether the source was queried and what it found: an EFRSB notice, case number, court, stage. The employee sees the matches and decides.

A result line for each source in the customer file

An EFRSB notice, an index case, a court card: how to read what was found

  • An EFRSB notice

The stage of the procedure matters more than the fact itself: restructuring, asset sale or a procedure already completed. A notice of out-of-court bankruptcy through an MFC is also bankruptcy, even though there is no court case.

  • A case in the Arbitration Case Index

Found by tax ID — so it is the same person. A bankruptcy case shows the number, court and stage; an ordinary arbitration dispute speaks of the person’s business, not their insolvency.

  • A court of general jurisdiction card

“Exact match” — the full name matches; “probable namesake” — the surname and initials match. Check the region and the substance of the case before drawing a conclusion: the card has no date of birth.

“Not found” means there were no records on the date of the request. If a source did not respond, the check is marked “not checked” and the run is repeated — the service never returns an empty result in place of a real one.

Creditor, lessor, employer, property buyer: who needs to know about a customer’s bankruptcy

The check is used where the law ties bankruptcy to a company decision: lending money, transferring property, appointing to a position or closing a deal.

  • Bank, microfinance organisation, cooperative

Five years after bankruptcy a person takes a loan or credit only while stating that fact. The check shows whether the customer kept quiet about it on the form.

    • Federal Law 127‑FZ, Art. 213.30, para. 1
  • Leasing and instalments

During debt restructuring, a loan, credit or pledge requires the written consent of the financial manager. Without it a deal with a customer in the procedure is a risk.

    • Federal Law 127‑FZ, Art. 213.11, para. 5
  • Employer and shareholders

For three years after bankruptcy a person cannot sit on the governing bodies of a legal entity, for ten years — of a credit institution, for five years — of an insurer, a non-state pension fund or a microfinance company. Check before appointing.

    • Federal Law 127‑FZ, Art. 213.30, para. 3
  • Property buyer

An apartment, car or share owned by a citizen in bankruptcy is sold only with the financial manager’s consent. Run the check before the deposit, not after.

    • Federal Law 127‑FZ, Art. 213.11, para. 5
  • Landlord

Long-term rental of housing, an office or equipment: bankruptcy and debt claims are a reason to ask for a deposit or a guarantor.

    • Rental
  • Platform and marketplace

A sole-proprietor seller is an individual with a personal tax ID: bankruptcy and arbitration are checked by the same request. The company — at counterparty check page.

Application, payout, arrears, appointment: when to repeat a bankruptcy check

  • The “NeuroVision” tag — performed by the service, “Your system” — by you. There is no automatic notification of a new procedure: a re-check is a repeat request on your schedule.

The customer turned out to be bankrupt: what changes in the deal and in handling the debt

Bankruptcy does not forbid working with a person. But it changes how debt is collected, who signs deals and which positions they can be appointed to.

  • Claims — only in the case

Once debt restructuring is opened, creditors’ claims are filed only in the bankruptcy case and enforcement documents on property recovery are suspended. Interest and penalties stop accruing.

  • Deals — through the manager

Loans, credits, guarantees, pledges, and deals involving real estate, vehicles and property worth more than ₽50,000 are made by the customer only with the financial manager’s written consent.

  • A new loan — with disclosure

For five years after the procedure ends, a person must state the fact of bankruptcy when taking a credit or loan. The check confirms they did.

  • Positions — with restrictions

Three years — no seats on the governing bodies of legal entities, ten years — in banks, five years — in insurers, non-state pension funds, fund management companies and microfinance companies.

A company, a criminal record, debts with no court: what a bankruptcy check will not show

  • Company bankruptcy

This page checks an individual and a sole proprietor. Bankruptcy, arbitration and debts of an organisation, its executive and founders — in one request by the company’s tax ID in counterparty checks.

  • Criminal record

A criminal case on a court card is not a certificate of no criminal record. The certificate is issued by the Ministry of Internal Affairs to the person, and an employer may demand it only where the law provides.

  • Debts that never went to court

Arrears without a claim are not visible in courts. What bailiffs are already collecting — in the FSSP database check; credit load before any court case is shown by  scoring with the customer’s consent.

The service works only with legal entities and sole proprietors under a contract — for loans, deals and hiring. You cannot check yourself or an acquaintance through NeuroVision.

Frequently asked questions about bankruptcy and court case checks

Submit the passport or tax ID — via API, from a KYC session or in the workspace. We check EFRSB and the Arbitration Case Index by tax ID, with no namesakes, and return notices and cases with the stage of the procedure. Each check — ₽5.

Yes. The notice of the start of an out-of-court procedure is included in EFRSB, and the check finds it. There is no such case in the courts — so EFRSB is always checked, even if arbitration is empty.

EFRSB and the Arbitration Case Index know a citizen’s tax ID, so a search by it does not confuse namesakes. The system gets the tax ID from the passport itself — only the patronymic is needed.

EFRSB — by full name and date of birth, courts of general jurisdiction — by full name. Arbitration cases are not checked without a tax ID: the check is marked skipped and not charged.

Disputes where they are plaintiff, defendant or third party — most often as a sole proprietor or former executive. A bankruptcy case is a separate check.

Criminal, civil and administrative cases in GAS Pravosudie and in Moscow courts. Results are split into exact matches of the full name and probable namesakes.

They can, but for five years after the procedure ends they must state the fact of bankruptcy. During restructuring, credits and loans — only with the financial manager’s consent.

Three years after bankruptcy — no, unless the law provides otherwise; at a credit institution — ten years, at an insurer, non-state pension fund, fund management company or microfinance company — five years.

You determine the basis for processing as the operator: consent, contract, law or data that must be published. For candidates, if data is obtained from a third party, notice and written consent are required.
