Checking candidates and employees with their consent: documents, debts, courts and links with companies

Checking candidates when hiring — only with written consent and only what relates to the position. The passport and the INN — without manual entry, the SNILS, wanted lists, debts, bankruptcy, courts and links with companies — in one run of checks. The report is for a human's decision, not for an automatic refusal.

Data is kept in Russia · Register of Russian software No. 19972 · 152‑FZ and 242‑FZ

What can be lawfully checked about a candidate, and what cannot

  • The passport: whether it is valid against the Ministry of Internal Affairs database and whether it has been altered in the photo. The candidate presents the passport anyway when hired — Art. 65 of the Labour Code (in NeuroVision) Allowed with consent
  • SNILS and INN: whether they belong to the candidate. The SNILS is a document from the list in Art. 65 of the Labour Code, the INN is determined from the passport (in NeuroVision) Allowed with consent
  • A diploma, a certificate, a permit — authenticity with the organisation that issued them. They may be required if the job calls for special knowledge (Art. 65 of the Labour Code) (not in NeuroVision) Only for certain positions

  • Wanted lists of the Ministry of Internal Affairs, the Federal Penitentiary Service and the Federal Bailiff Service (in NeuroVision) Allowed with consent
  • Enforcement proceedings and alimony debts — for positions with financial liability, access to the cash desk and clients' money. A debt in itself is not grounds for refusal (in NeuroVision) Allowed with consent
  • Bankruptcy: after the procedure ends a citizen may not hold positions in the management bodies of a legal entity for three years, and in financial organisations — longer (Art. 213.30 of the bankruptcy law) (in NeuroVision) Only for certain positions

  • Civil, administrative and arbitration cases involving the candidate (in NeuroVision) Allowed with consent
  • A criminal record certificate — only where the law does not admit persons with a criminal record to the work: work with children, medicine and social services for minors, security, transport and others (Art. 65, 331, 351.1 of the Labour Code). The certificate is obtained by the candidate (not in NeuroVision) Only for certain positions
  • Criminal cases from court records are not a criminal record certificate: the record has no date of birth, the sentence may not have entered into force or may be an acquittal. Run them only if the law restricts hiring for the position (in NeuroVision) Only for certain positions
  • A spent or expunged conviction: it annuls all legal consequences, it may not be taken into account when hiring (Part 6, Art. 86 of the Criminal Code) Not allowed

  • Credit history — only through a credit bureau and only with the candidate's consent (Art. 6 of Federal Law No. 218-FZ), for positions where this relates to business qualities (not in NeuroVision for hiring) Only for certain positions
  • Property, income, family expenses, salary at the previous job — property status is not related to business qualities (Art. 64 of the Labour Code) Not allowed

  • Where the candidate is a founder or a head, whether they have sole-proprietor status — for procurement, finance and management positions: organisations must prevent a conflict of interest (Art. 13.3 of Federal Law No. 273-FZ) (in NeuroVision) Allowed with consent
  • Whether they are listed as a nominal or mass head of companies (in NeuroVision) Allowed with consent

  • The Rosfinmonitoring list and sanctions lists — for financial organisations and positions with access to payments; PEP — for management positions (in NeuroVision) Allowed with consent
  • A foreigner — the register of controlled persons of the Ministry of Internal Affairs: the employer is not obliged, but the Ministry of Internal Affairs recommends checking. Details — on the page on hiring foreign workers (in NeuroVision) Allowed with consent
  • The register of foreign agents — only if the law sets a restriction for a foreign agent for the position (in NeuroVision) Only for certain positions

  • Health — only information on the ability to perform the job function; where required — a medical examination (Art. 88 of the Labour Code) (not in NeuroVision) Only for certain positions
  • Political and religious beliefs, private life, membership of public associations and trade unions (cl. 4–5, Art. 86 of the Labour Code) Not allowed
  • Pregnancy, having children, marital status, age, nationality, place of residence as a reason for refusal (Art. 64 of the Labour Code) Not allowed

  • A request to the former employer and references — with the candidate's consent: this is how Roskomnadzor explains it (not in NeuroVision) Allowed with consent
  • Social networks, unofficial databases and “lookups”: there is no lawful basis and the source cannot be verified (Part 1, Art. 13.11 of the Code of Administrative Offences) Not allowed
  • A refusal based only on a service's report, without a human assessment (cl. 6, Art. 86 of the Labour Code) Not allowed
  • Allowed with consent — the information can be requested from third parties after notifying the candidate and with their written consent
  • Only for certain positions — only if the law or the specifics of the position justify it; the list of positions is checked by a lawyer
  • Not allowed — the law prohibits requiring or taking into account such information

The candidate's consent to a database check: what to write in it

Information on a candidate from third parties — registers, courts, bureaus — the employer obtains only after notification and with written consent. The consent is a separate document, not a line in a questionnaire.
The text of the consent is prepared by your lawyer: below is what it must contain for a database check to be lawful.

  • What to specify

    152-FZ, Part 4, Art. 9; Labour Code, cl. 3, Art. 86.

    What can be checked

    Purpose and list

    • The purpose — a decision on hiring for a specific position
    • The list of checks and information: passport, SNILS, INN, enforcement proceedings, courts — only what is needed for this position

    Sources and the service

    • Which registers and databases will be queried
    • Who is entrusted with the check — the service that receives the data on the employer's instruction

    Period and withdrawal

    • The period of validity of the consent and the procedure for withdrawing it
    • The consequences of refusing to give consent
  • How to execute it

    152-FZ, Part 1, Art. 9 as amended by 156-FZ, Art. 10.1.

    How the check goes

    Separately

    • Since 1 September 2025 — as a separate document, not an item of a questionnaire, contract or user agreement
    • The consent is specific, substantive, informed, conscious and unambiguous

    In writing

    • The candidate's signature on paper or an electronic signature
    • A questionnaire on a hiring service's website — a separate checkbox, not ticked in advance

    Dissemination

    • Consent to the dissemination of personal data is another document. It is not needed for a database check: the employer does not publish the data
  • What to do afterwards

Labour Code, Art. 64, cl. 6, Art. 86; Roskomnadzor's clarifications.

    Choose the checks

    Decision

    • The result is assessed by a person, not by a rule in a system
    • The candidate has the right to request the reason for refusal in writing — the answer no later than 7 working days

    Storage

    • Refused — destroy the candidate's data within 30 days
    • Hired — the check result is kept in the personal file under the rules for processing employees' data

    Withdrawal of consent

    • The candidate withdrew consent — do not start the check, do not use previously received results for new decisions

A criminal record certificate: who can be required to provide it and why databases do not replace it

A criminal record is information of a special category

The employer may process it only in cases directly established by federal law. For other positions the question of a criminal record is a risk of discrimination.

  • 01

    When the certificate is required

If the law does not admit persons with a criminal record to the work: work with children, medicine and social services for minors, children's sport, private security, a number of positions in transport and in state bodies. Then the certificate is a document from the list on hiring.

  • 02

    Who obtains it

The certificate is issued by the Ministry of Internal Affairs — on the application of the person themselves, including through Gosuslugi. The employer cannot request it for the candidate, and database check services do not replace it.

  • 03

    A spent conviction

When a conviction is spent or expunged, all its legal consequences are annulled. Such a conviction cannot be taken into account when hiring for an ordinary position.

  • 04

    A criminal case in court

A case record in a court of general jurisdiction is not a criminal record: it has no date of birth, the sentence may not have entered into force or may be an acquittal. Include such records in a check only if there is a lawful restriction for the position.

  • Art. 351.1 work with minors
  • 7 working days a written answer to the candidate on the reason for refusal
  • 30 days to destroy the candidate's data after a refusal

Financial and management positions: business reputation, conflict of interest, credit history

  • Banks and financial organisations

Business reputation. The law sets business-reputation requirements for the heads, chief accountants, their deputies and board members of banks, insurers, pension funds and microfinance companies, and compliance is assessed by the Bank of Russia. NeuroVision — data for your assessment: bankruptcy, courts, links with companies, nominal management.

The AML/CFT officer. For a special official the Bank of Russia sets qualification requirements. NeuroVision — the Rosfinmonitoring list, sanctions and PEP for the candidate.

Decision. Assessed by the organisation and the Bank of Russia. NeuroVision does not replace this procedure.

  • Conflict of interest

The organisation's duty. To take measures to prevent corruption, including preventing and resolving a conflict of interest. NeuroVision — where the candidate is a founder or head, whether they have a sole-proprietor registration.

Procurement and supply. A candidate linked to a supplier is a reason for an interview question and a declaration. NeuroVision — matching the INNs of the companies from the response with your counterparties.

A nominal director. A person is listed as the head of dozens of companies. NeuroVision — a sign of a nominal or mass head.

  • Credit history

How to obtain it. Only through a credit bureau and only with the candidate's consent, which states the purpose and the user. NeuroVision — we do not offer credit checks for hiring.

When appropriate. For positions with full financial liability and access to money — on a lawyer's decision. A refusal because of debts unrelated to the position is a risk under Art. 64 of the Labour Code. NeuroVision decides nothing for you.

What instead. Enforcement proceedings and bankruptcy show collections and procedures, not payment discipline. NeuroVision — 5 ₽ per check.

Check the candidate's companies as a counterparty: status, signs of a shell company, courts and founders by INN — on the page counterparty checks.

Employer's fines for excess information on a candidate and for discrimination

The amounts are under the Code of Administrative Offences as amended by 420-FZ, in force since 30 May 2025. The fine threatens the organisation and, separately, an official: the head of the HR service or the security service.

  • A check without a lawful basis: excess information, purposes not related to the work

    Individuals — 10 000–15 000 ₽

    Officials — 50 000–100 000 ₽

    Organisations and sole traders — 150 000–300 000 ₽

  • There is no written consent or it does not meet the requirements

    Individuals — 10 000–15 000 ₽

    Officials — 100 000–300 000 ₽

    Organisations and sole traders — 300 000–700 000 ₽

    • Part 2, Art. 13.11 of the Code of Administrative Offences
  • A repeat violation involving consent within a year

    Individuals — 15 000–30 000 ₽

    Officials — 300 000–500 000 ₽

    Sole trader — 500 000–1 000 000 ₽

    Organisations — 1 000 000–1 500 000 ₽

    • Part 2.1, Art. 13.11 of the Code of Administrative Offences
  • A refusal for circumstances not related to business qualities

    Individuals — 1 000–3 000 ₽

    Organisations — 50 000–100 000 ₽

The candidate has the right to appeal the refusal in court

    • Art. 5.62 of the Code of Administrative Offences; Art. 64 of the Labour Code

Banks, retail, logistics, IT and recruitment agencies: a set of checks for the position

A pre-hire check of a candidate is built around the risk of the position, not the industry. A cashier and a finance director of the same bank need different sets — and different lines in the consent.

  • Banks and financial organisations

    • Heads and chief accountants — business-reputation requirements, the AML/CFT officer — qualification requirements
    • Bankruptcy, courts, links with companies, nominal management
    • The Rosfinmonitoring list, sanctions, PEP for management positions
  • Retail, warehouses and cash-desk positions

    • Financial liability and access to the cash desk
    • Passport validity, wanted lists, enforcement proceedings
    • Mass hiring — a web interface without integration or an API for the recruiting system
  • Logistics and transport

    • A driver — licence against the traffic police database — a separate set
    • A forwarding agent and a storekeeper — passport, wanted lists, debts
    • A criminal record certificate — only where the law requires it for a driver
  • IT and access to clients' data

    • A remote candidate — a passport by a photo and anti-fraud document anti-fraud: screen, photocopy, traces of editing
    • Links with companies — for conflict of interest when working with contractors
    • Checking that the same person is at a video interview — is prepared after a legal assessment under 572-FZ
  • Recruitment agencies, staff outsourcing and hiring services

    • A check before passing the candidate to the customer
    • Passing data to the customer — only with the candidate's written consent
    • A REST API into the recruiting system, a report with the source and date of each check
  • An interview and a candidate check in an office

From consent to report: how a candidate check works before hiring

The candidate signs the consent and uploads the passport — then the check goes on without retyping the data and without manual searching on agency websites.

Step 1

Consent and passport

The candidate signs the consent as a separate document and photographs the passport by a link or in a questionnaire. The full name, date of birth, series, number and date of issue arrive as JSON fields, and the document is checked for a photo of a screen, a pasted-in photo and traces of editing.

The candidate's consent to the check and passport recognition without manual entry
Step 2

A set of checks for the position

In one run — only the checks from the consent: passport validity, INN, SNILS, wanted lists, enforcement proceedings, courts, links with companies. For a foreigner — the register of controlled persons of the Ministry of Internal Affairs and lists.

A set of candidate checks for the position in one run
Step 3

A report for a human's decision

For each check — the source, the date and the records found, matches by full name only are marked separately. The decision is made by HR or the security service; the candidate has the right to learn the reason for refusal.

A candidate check report with the source and date of each record

A namesake in the report: why a full-name match is not a reason for refusal

There is the candidate's passport

Unambiguous

From the passport the system obtains the INN and then searches for the candidate by it: bankruptcy and arbitration cases relate to them, not to a person with the same surname.

Only full name and date of birth

With flags

Wanted lists and enforcement proceedings are filtered by date of birth. If the date in the register is incomplete, the match is marked as needing clarification — it must be checked, not counted.

Court cases

Exact and probable

Court records have no date of birth. The report divides cases into exact matches of the full name and probable namesakes and cuts off cases from before the candidate came of age. A probable match is a question for the interview, not a refusal.

Verifying employees after hiring: when to repeat the check

A security service check of an employee is the same processing of personal data as when hiring: a lawful purpose, a link with the work and consent to obtain information from third parties are needed. It cannot be repeated “just in case” across all staff.

  • A move to a new position

An employee moves to a position with financial liability, access to payments or a management one. A new position means a new purpose: the set of checks and the consent — for it.

  • A requirement of the law or the regulator

Financial organisations assess the business reputation of their heads not only on appointment. A foreigner can get into the register of controlled persons after hiring, when their document's validity has expired.

  • Safeguarding property

The Labour Code allows processing an employee's data to control the quality of work and safeguard property. A database check — after a shortage or an incident, on a specific employee, not on all.

  • How to execute it

Consent to a repeat check — with the same precision as when hiring: purpose, list, period. The request is repeated on previously received data, the passport does not need to be uploaded a second time.

Checks for HR and the security service: catalogue and prices

Each check is switched on separately — take into the set only what is stated in the candidate's consent. Payment is for the requests made; a check for which there was not enough data is not charged. All database checks — in thegeneral catalogue.

Candidate-check glossary: consent, operator, business qualities

Briefly on the concepts that come up when an employer checks a candidate and an employee.

Personal data operator
The one who determines the purposes and content of the processing. When checking a candidate the operator is the employer, the check service processes the data on its instruction.
Data controller
Consent to personal data processing
A document in which a person permits the processing of their data for a specific purpose. Since 1 September 2025 it is executed separately from other documents.
Consent to data processing
Obtaining information from a third party
A request for data on a candidate not from them but in registers, courts, from a former employer. Possible only after notification and with written consent.
Third-party data collection
Business qualities
The abilities, qualifications, experience and personal qualities needed for the work. A refusal to hire — only on them, otherwise — discrimination.
Business qualities

The expiry of the period after which a conviction annuls all legal consequences. A spent conviction is not taken into account when hiring.
Expunged conviction
Enforcement proceedings
Recovery of a debt by bailiffs under a court decision or another document: a loan, a tax, a fine, alimony.

Frequently asked questions about checking candidates and employees

Determine which information relates to the position, obtain from the candidate a written consent as a separate document and run only the checks listed in it. In NeuroVision this is one run of checks after the passport is uploaded: passport validity, INN, SNILS, wanted lists, debts, courts, links with companies. The decision on the results is made by a person.

With consent — authenticity and validity of documents, wanted lists, enforcement proceedings, bankruptcy, civil and arbitration cases, links with companies, lists and sanctions for financial positions. A criminal record, health and credit history — only for positions where the law provides for it. Beliefs, private life and marital status — not allowed.

No, if the information is requested from third parties — registers, courts, bureaus, a former employer. The Labour Code requires notifying the candidate and obtaining written consent. Without consent, where it is needed, the organisation faces a fine of 300 000 to 700 000 ₽.

No. A criminal record certificate is issued by the Ministry of Internal Affairs and obtained by the candidate themselves — if the position is on the list where the law does not admit persons with a criminal record. Criminal case records in courts are not a criminal record: they have no date of birth, and the sentence may not have entered into force.

Only if this relates to business qualities for the specific position — for example, full financial liability. A refusal for circumstances not related to business qualities is prohibited. The candidate has the right to request the reason for refusal in writing, the answer — no later than 7 working days.

No. Credit history is available only through a credit bureau and with the candidate's separate consent. Collections and personal bankruptcy are shown by checks of enforcement proceedings and the Unified Federal Register of Bankruptcy Information — 5 ₽ each.

A check of links with companies shows where the candidate is a founder or a head and whether they have a sole-proprietor registration, and a check of nominal heads — whether they are listed as the director of many companies. Match the INNs of these companies with your counterparties and ask questions at the interview.

Match the date of birth and the region, and if in doubt — ask the candidate. When there is a passport, the system searches by INN and does not confuse namesakes; where the register knows only the full name, matches are marked separately. A match by surname is not grounds for refusal.

If the candidate was refused, their data is destroyed within 30 days — as Roskomnadzor explains. If hired — the result is kept in the personal file under the rules for processing employees' data.

Yes, with a lawful purpose and with consent: a move to a position with financial liability, regulator requirements, an investigation of a shortage. Re-verifying the whole staff without a reason is excessive processing. In NeuroVision a repeat is the same request on previously received data.
