What 115‑FZ requires of an estate agency

Companies and sole traders providing intermediary services in property sales are covered by 115‑FZ. They are supervised by Rosfinmonitoring itself.
NeuroVision provides the data for checking clients. The internal control rules, the decision on the deal and the reports to Rosfinmonitoring are the agency's. An agency may delegate client identification to a credit institution under contract (115‑FZ, art. 7, cl. 1.5‑10).

  • Registration and control rules

115‑FZ, art. 5 and art. 9.1, cl. 2; Decree No. 58 — registration; Decree No. 1157 — requirements for internal control rules.

Seller or buyer: whom the agency checks under 115‑FZ

An agency usually has one client — whoever signed the contract. But the risk has two sides, and each may have a representative and a beneficial owner. The agency sets out the checks for each role in its internal control rules: NeuroVision returns the result with its source and date, and the dedicated compliance officer decides.

  • The client — the seller or the buyer

    • Whoever signed the contract with the agency: the seller or the buyer. Contracts with both sides mean two clients
    • Under 115‑FZ — identification before they are taken on, the watchlist, PEP lists, risk assessment
    • The beneficiary is the person for whose benefit the client acts: the flat is registered to the buyer, but someone else pays
    • The client or their beneficial owner is a  politically exposed person: special measures under the internal control rules — a decision by the head of the agency, the source of funds, enhanced monitoring
    • NeuroVision — passport recognition, the watchlist, sanctions, PEP lists
  • A representative under a power of attorney

    • Signs the contract or handles the deal for the owner: a relative, a lawyer, another estate agent
    • Under 115‑FZ — identification and the watchlist, as for the client
    • For the deal's sake — the authority and validity of the power of attorney: its revocation shows only in the Notary Chamber register
    • NeuroVision — the passport and the watchlist; the power of attorney — in the Notary Chamber register, not at NeuroVision
  • A seller with no contract with the agency

    • The other side of the deal, when the agency works for the buyer
    • For the deal's sake — whether they are the owner, and whether there is bankruptcy, debt or a wanted-list entry
    • NeuroVision — passport validity, bankruptcy, the bailiffs, wanted lists
  • The seller or the buyer is a company

    • Under 115‑FZ — identification and steps to establish the beneficial owner
    • A beneficial owner is a person who owns more than 25 % of the company or controls it
    • For the deal's sake — status, signs of a shell company, the director
    • NeuroVision — 20+ checks by tax number
  • A foreign national

Six tasks for an agency in a sale

Between the viewing and the registration of title, the agency answers to the client for the seller, and to Rosfinmonitoring for its clients. These are the tasks NeuroVision covers.

  • The parties' passports with no retyping

The agent photographs or scans the seller's and the buyer's passports — the name, series and number, issuing authority and date and the registered address are read in a second and land in the form and the draft contract.

A citizen, a foreign national, a company: three seller profiles

  • A Russian citizen

The passport is read into the form. Passport validity, bankruptcy, enforcement proceedings, wanted lists and pledges over movable property — by passport, with no namesakes. The watchlist, sanctions and PEP lists — if the seller is your client.

  • A foreign national

A passport from 195+ countries and territories with no manual entry, and the name in Latin script from the MRZ. The police register of controlled persons, sanctions lists and PEP compliance screening — by name and date of birth.

  • A company or sole trader

Status in the state registers, shell company signs, a nominee director, court cases, debts and account freezes. The director and the founders — against the watchlist and sanctions lists. The beneficial owner under 115‑FZ is established by the agency.

Your internal control rules set the combination of checks for each party.
NeuroVision returns the result with its source and date.

How an agency checks the parties with NeuroVision

The check runs before the deposit, alongside the request for a property register extract. By the time the preliminary contract is signed, the agent already knows whether the seller has a bankruptcy or a watchlist match.

Step 1

Passports — into the form

The agent photographs the passport at the meeting, or receives a scan from the client. The fields and the registered address are read and land in the client's form and the draft contract with no retyping.

Reading the passport of a flat's seller: fields and registered address with no retyping
Step 2

The parties — against databases and lists

The seller — against police data, the bankruptcy register, the bailiffs and wanted lists; clients — against the watchlist, sanctions and PEP lists; a company — by tax number. Only what your internal control rules require.

Checking a seller against police data, the bankruptcy register, the bailiffs, wanted lists and the Rosfinmonitoring watchlist
Step 3

The result — into the deal file

For every check — the result, the source and the date. The report is kept in the client's file for five years, as 115‑FZ requires. The decision on the deal and the reports to Rosfinmonitoring are the agency's.

How to check the seller of a flat: eight steps for an agency

  • Who the owner is and how many there are; the name and passport details must agree with the extract Property register
  • A mortgage, an attachment, a ban on registration actions, how often the owners have changed. NeuroVision does not request property register data Property register

  • The passport is read from a photo or a scan — with no retyping NeuroVision
  • Validity against police data: a replaced, lost or invalid document shows at once NeuroVision
  • Traces of editing and shots taken off a screen — document anti-fraud NeuroVision
  • Whether the person at the meeting matches the passport photo; legal capacity, a spouse's consent and the consent of the guardianship authorities The agent or a notary

  • The passports of the representative and the principal — validity and wanted lists NeuroVision
  • The power of attorney and its revocation — in the Notary Chamber register of notarised powers of attorney. NeuroVision does not check powers of attorney The agent or a notary

  • The federal bankruptcy register and the commercial court case file — by tax number, with no namesakes NeuroVision
  • Signs of bankruptcy to come — commercial court claims, large debts: an unequal deal can be challenged within a year before the bankruptcy petition, and a deal harming creditors — within three years NeuroVision
  • Once an individual is declared bankrupt, only the trustee may dispose of their property NeuroVision

  • Live proceedings: amounts, claimants, the type of enforcement and an estimate of how close bankruptcy is NeuroVision
  • A ban on registration actions over the flat shows in the property register, not in the bailiffs' database Property register

  • The federal police wanted list, the prison service list and the bailiff list — in a single request. A seller on a wanted list is a reason to stop the deal NeuroVision

  • Whether the seller's cars and equipment are pledged against loans — a signal of their debt load NeuroVision
  • A mortgage over a flat is not in the pledge register — it is in the property register Property register

  • The Rosfinmonitoring watchlist — under 115‑FZ NeuroVision
  • Sanctions lists and PEP lists — under the internal control rules NeuroVision
  • A corporate seller — by tax number: status, shell company signs, a nominee director, court cases and debts NeuroVision
  • NeuroVision — the item is covered by a NeuroVision check: the result, the source and the date
  • Property register — details of the property from a Rosreestr extract; NeuroVision does not request property register data
  • The agent or a notary — a step without NeuroVision: the power of attorney in the Notary Chamber register, the seller's legal capacity and the consent of a spouse and the guardianship authorities are handled by the agent, the deal's lawyer or a notary

NeuroVision: the federal bankruptcy register and commercial court cases by tax number, with no namesakes

  • Debts with the bailiffs

Without NeuroVision: the bailiffs' database — by name
NeuroVision: amounts, claimants, an estimate of how close bankruptcy is

  • Wanted lists

Without NeuroVision: the police, prison service and bailiff websites — one by one
NeuroVision: three databases in a single request

  • Watchlist, sanctions, PEP

Without NeuroVision: the Rosfinmonitoring personal account — the watchlist
NeuroVision: the watchlist 5 ₽, compliance screening 36 ₽, the result with its date

  • A corporate seller

Without NeuroVision: a state register extract
NeuroVision: 20+ checks by tax number

The flat is shown by the property register, the power of attorney — by the Notary Chamber register, and the people in the deal — by NeuroVision. That makes it simpler not to look in the product for what is not there, and not to do by hand what one request answers.

The dedicated compliance officer
The member of staff responsible for the internal control rules and for reporting to Rosfinmonitoring.
The Rosfinmonitoring list
The list of organisations and individualsinvolved in extremist activity or terrorism. Screening against it is mandatory.
Mandatory monitoring
Transactions an organisation reports to Rosfinmonitoring of its own accord, with no suspicion involved. For property deals — by the amount threshold.
The beneficial owner
The person who ultimately owns or controls a company.
PEP
A politically exposed person: a senior official, the head of a state company or an international organisation, and their relatives too.

Agencies' common questions about 115‑FZ and checking a seller

Yes. Companies and sole traders providing intermediary services in property sales are named in article 5 of 115‑FZ. They register with Rosfinmonitoring, approve internal control rules, identify their clients and screen them against the watchlist. This duty does not extend to letting.

In the manner set by the Government (Decree No. 58). Once registered, the agency receives a registration number and access to a personal account on the Rosfinmonitoring website — watchlists arrive through it, and reports go out through it.

Its own client — whoever the contract is with — together with their representative, the beneficiary and the beneficial owner of a corporate client. If the agency works with both sides, there are two clients. The other party is checked for the safety of the deal — under the agency's own rules.

For intermediaries — transactions in a property deal above 5,000,000 ₽, where the transaction goes through the agency (Rosfinmonitoring order No. 13, from 10.03.2026), and any transaction with a person on the watchlist. The report is filed no later than three working days after the transaction.

Before they are taken on, and at least once every three months — across the whole client base. On a match, freezing measures are applied within 24 hours of the watchlist being published.

Against the federal bankruptcy register and the commercial court case file — bearing the time limits in mind: an unequal deal can be challenged if it was made within a year before the bankruptcy petition, and a deal harming creditors — within three years. NeuroVision checks both sources by the seller's tax number and shows debts with the bailiffs.

No. Owners, mortgages and attachments are shown by a property register extract, and a power of attorney — by the Notary Chamber register. NeuroVision checks the people in the deal: passport, bankruptcy, debts, wanted lists, watchlists and sanctions, and a company by tax number.

Whether the seller's cars and equipment are pledged against loans — from the register of notices of pledges over movable property. A mortgage over a flat is not there: it shows in the property register.

No. Identification is carried out by the agency under its own internal control rules. NeuroVision reads the passport and checks the data against databases and lists — the agency uses the results in its own procedure and attaches them to the client's file.

Under article 15.27 of the Administrative Offences Code: for breaches of internal control — from 50,000 to 100,000 ₽ for a company; where they mean a report never reaches Rosfinmonitoring — from 200,000 to 400,000 ₽, or suspension of activity for up to 60 days; for failing to apply freezing measures — from 300,000 to 500,000 ₽, or suspension for up to 60 days. Sole traders are liable as companies.

By tax number: status in the state register, signs of a shell company, a nominee director, court cases, debts and account freezes — 20+ checks. The director and the founders — against the watchlist and sanctions lists.

Checks against databases and lists cost from 5 ₽, a package of 16 checks from a passport — 50 ₽, and PEP and sanctions compliance screening — 36 ₽. Passport recognition is priced on request. Test access — 1 month.
