Debtor identification for debt collection agencies: phone number, passport and bankruptcy before the first call

Under the debt collection law, it matters not only how you speak but also who you speak to. We check that the number in the file belongs to the debtor, the passport is valid and there are no bankruptcy proceedings. When the debtor or a third party gets in touch on their own, their identity is confirmed by a document with Liveness.

The collectors law: who you may talk to about a debt, when to stay silent and what to say at the start of a call

The law on protecting citizens’ rights when recovering overdue debts (230‑FZ) applies to banks, microfinance organisations, professional collection agencies and other creditors. Almost every restriction in it is tied to identity: whether the person you are talking to is the debtor, whether they are bankrupt, whether they have given consent.
Calls, limits and recordings are handled by your collection system. Our task is to make sure the file it works from is correct.

  • The debtor and third parties

    230‑FZ, Art. 4, 6

    Phone number check

    Third parties

    • Relatives, neighbours, colleagues — only with the consent of both the debtor and the third party
    • Both consents — in writing, as separate documents
    • The same rules apply to a guarantor and a pledgor

    Debt information

    • Not passed to third parties without the debtor’s consent
    • Consent — as a separate document
    • At the workplace and in public — not allowed even with consent

    What follows from this

    • The number in the file must belong to the debtor
    • A voice on the phone is not yet proof of identity
  • When contact is prohibited

    230‑FZ, Art. 7, 8

    Database checks

    Bankruptcy

    • Calls and meetings are not allowed from the day debt restructuring is introduced
    • Or from the day the person is declared bankrupt

    The debtor’s circumstances

    • Legal incapacity, inpatient treatment, Group I disability, being a minor — if confirmed by documents

    Refusal and a lawyer

    • Contact can be refused four months after the payment is overdue
    • It must stop within three business days
    • Or you speak only to the debtor’s lawyer
  • A call by the rules

    230‑FZ, Art. 7, 13, 17

    Liveness

    Time and frequency

    • Not from 10 pm to 8 am on weekdays and not from 8 pm to 9 am at weekends
    • Calls — no more than once a day, twice a week, eight times a month

    Start of the conversation

    • The employee’s name and INN
    • The creditor or their representative
    • Debt details and the amount

    Collection agency

    • A business company in the state register of the Federal Bailiffs Service
    • Net assets and insurance — from RUB 10 million
    • Call recordings and documents — kept for at least a year and a half

Collection agency, bank collections department, portfolio buyer: who checks the debtor’s file and why

The law is the same, but files arrive in different ways: from the creditor’s register, from a purchased portfolio or from your own database.

  • A collection agency under an agency agreement

    • The file comes from the creditor, contacts may be out of date
    • The number is checked before the first call
    • Bankruptcy — before every new wave of calls
  • A collection agency as the new creditor by assignment

    • A portfolio of old debts, sometimes several years old
    • Passports from the file — checked for validity
    • Document scans — through anti-fraud
  • A bank or MFO collections department

  • Instalments, leasing, car sharing

    • Debts of individuals to a non-bank creditor
    • The same law — the same restrictions
    • Number, passport and bankruptcy — via API
  • The claimant’s lawyers

    • A claim file — with a current passport and INN
    • The debtor’s bankruptcy — before filing the claim
    • Enforcement proceedings — from the Federal Bailiffs Service database
  • A collections operator’s workstation: a headset and file folders

Number, passport, INN, bankruptcy: what to verify before first contact with the debtor

Four checks answer the question “may we call, and whom”. They work on the data already in the file — and look up nothing beyond it. For details on the contact check, see the page on matching a full name with a phone number.

  • The number belongs to the debtor

A “yes” or “no” answer: whether the number in the file is linked to the debtor’s full name according to the mobile operator.

“No” — a reason not to call: the number may have passed to another subscriber, and a conversation about the debt would disclose it to a stranger.

    • 5 ₽ per check
  • The number is live and not new

Activity — whether the number is currently in service; number age — how long the subscriber has been using it.

A disconnected number does not use up the call limit; a fresh one is a signal to check ownership.

    • 5 ₽ per check
  • Passport and taxpayer ID (INN)

Passport validity from the file against the Ministry of Internal Affairs database and INN by passport — so that people with the same name are not confused.

An invalid passport in an old debt — a reason to check the file for forgery.

    • 5 ₽ per check
  • Bankruptcy and bailiffs

Bankruptcy information — via the Federal bankruptcy register; enforcement proceedings — via the Federal Bailiffs Service database.

Restructuring or bankruptcy — calls and meetings stop, claims go through the procedure.

    • 5 ₽ per check

A debt portfolio in three steps: register, checks, call queue

Your collection system sends files via API requests, receives an answer for each check and itself decides whom to call, whom to write to and whom to set aside.

Step 1

A file from the register

Full name, date of birth, passport and phone number from the file go to the API — one request per debtor. The system obtains the INN from the passport itself.

A debtor’s file sent for checking: full name, passport and phone number
Step 2

Database and number checks

Ownership and activity of the number, bankruptcy, enforcement proceedings, passport validity. The answer comes separately for each check; “not checked” does not mean “clean”.

Answers on the number, bankruptcy, bailiffs and passport
Step 3

A queue by your rules

Number confirmed — the debtor goes into the call campaign. Number belongs to someone else — letters only. Bankruptcy — the debt leaves the call campaign. The decision is made by your system.

A debtor placed in the call queue by the agency’s rules

A call to the wrong person: what an error in the debtor’s file costs

Three deadlines in the law

Every conversation with a collection agency is recorded and kept for a year and a half. If a call was unnecessary, the recording becomes evidence in a complaint — and the question will be put not to the operator but to the file.

  • 01

A debt disclosed to a stranger

Five years ago the number in the file belonged to the debtor; now it belongs to someone else. The very first phrase about the debt discloses information to a third party without the debtor’s consent.

  • 02

A call to a bankrupt person

The debtor filed for bankruptcy and the court introduced restructuring. Calls after that date are prohibited, and the agency learns of it from a complaint.

  • 03

    The wrong namesake

The file holds only a full name and date of birth, and a namesake has the same surname. INN by passport and passport validity tell the two people apart.

  • 04

    A teenager on the phone

The number is registered to an adult, but a child picks up. You may not discuss a debt with a minor — a script rule and a number ownership check before the call.

  • 2 calls a week — the limit for a single debt
  • 4 months after the payment is overdue, the debtor may refuse calls
  • 3 working days to end contact after a refusal

A file checklist before a debt goes to work

Twenty items the agency checks before the first call or letter. The tag shows who closes each line.

  • The passport in the file is valid according to the Ministry of Internal Affairs database NeuroVision
  • INN obtained by passport — people with the same name are not mixed up NeuroVision
  • A passport scan from the credit file — with no traces of pasted-in photos or edits NeuroVision
  • Date of birth — the debtor is an adult NeuroVision
  • The debt did not arise from a sole proprietor’s business activity or from utility bills Legal

  • The number belongs to the debtor — the mobile operator’s answer is “yes” NeuroVision
  • The number is in service now NeuroVision
  • The number’s age matches the loan date NeuroVision
  • The subscriber’s consent to the number check — in the creditor’s file Legal
  • Third parties — only with two written consents Legal

  • No bankruptcy or restructuring in the Federal bankruptcy register NeuroVision
  • Enforcement proceedings on the debt are taken into account NeuroVision
  • Refusal of contact or the debtor’s lawyer — flagged Your system

  • Employees on the line — with no convictions the law prohibits Legal
  • Recordings of calls and messages — kept for at least a year and a half Your system
  • Script: the employee’s name and INN, the creditor, the debt amount Your system
  • A debtor who calls in passes a document and Liveness via a link NeuroVision
  • The answer for each check is saved in the file NeuroVision
  • NeuroVision — the line is closed by NeuroVision: number and database checks, passport, INN, document anti-fraud and Liveness

A relative, a guarantor, the new owner of a number: how to tell a third party from the debtor

  • The new owner of a number

NeuroVision. Answers “no” to whether the number belongs to the debtor and shows the number’s age.

Your system. Takes the number out of the call campaign before the first conversation.

  • A relative with consent

NeuroVision. Checks the third party’s document and Liveness via a link — the consent is signed by the person named in it.

Your system. Stores both consents — the debtor’s and the third party’s — as separate documents.

  • A guarantor and a pledgor

NeuroVision. Passport, INN and bankruptcy of the guarantor — with the same checks as for the debtor.

Your system. Applies the same restrictions to the guarantor as to the debtor.

  • The debtor’s lawyer

NeuroVision. Recognises the passport and power of attorney, flags traces of editing and photos of a screen.

Your system. Switches communication to the lawyer after the debtor’s statement.

We do not help find a debtor’s new number, address or relatives, and we do not do it ourselves: the checks work only with the data already in the file and with the subscriber’s consent.

The debtor called in: how to confirm identity before discussing the amount and instalments

An incoming call is also contact, and debt information must not be disclosed to someone who has merely named another person’s full name. A link to the document and Liveness check goes to the number or email in the file and takes a couple of minutes.

  • A call from an unknown number

The person gives the debtor’s full name and asks for the debt amount. Before answering — a link to a document and Liveness to the number in the file.

  • Instalments and a settlement agreement

The debtor is ready to sign a payment schedule. The passport is recognised into the contract without retyping, and Liveness confirms that they sign it themselves.

  • “It’s not my loan”

The person says the loan was taken out on their passport. A document with Liveness now and anti-fraud on the scan from the file — material to sort it out with the creditor.

  • Changing contacts in the personal account

The debtor changes the number or email used for contact. The document and Liveness again — before the new number enters the call campaign.

Checks for debt collection: catalogue and prices

Each check is enabled separately — you pay only for completed requests. A check skipped for lack of data is not charged.

Third party
Direct contact
In-person meetings, phone calls and conversations with an automated agent.
Direct contact
Refusal of contact

Questions about identifying debtors under 230‑FZ

Almost all restrictions in the collection law are tied to identity: you may not discuss a debt with a stranger, call a bankrupt person or continue after a refusal. Checking the file before the call lowers the risk that the conversation takes place with the wrong person.

Act in good faith, not disclose debt information to third parties without the debtor’s consent, observe contact times and frequency, and at the start of a conversation give the employee’s name and INN, the creditor and the debt amount. A collection agency records all conversations and keeps the recordings for at least a year and a half.

Only with the consent of both the debtor and the relative. Both consents are given in writing as separate documents. A debt may not be reported at the workplace or in public even with consent.

The “Phone belongs to the person” check, based on mobile operator data, answers “yes” or “no” to whether the number is linked to the debtor’s full name. It is run with the subscriber’s consent and costs 5 ₽. The number’s activity and age are checked separately.

No. Calls and in-person meetings are prohibited from the day debt restructuring is introduced or the person is declared bankrupt. The “Individual bankruptcy” check against the Federal bankruptcy register shows filed and completed cases.

Send a link to a document check and Liveness to the number or email in the file. The person photographs their passport and passes Liveness, and the selfie is compared once with the photo in the document. Until there is a result, debt information is not disclosed.

No. We do not offer recognition from stored voice or face samples. Identity is confirmed by a document and Liveness in one session.

No. The checks work only with the data from the file and answer whether it is correct. You cannot use them to find a person, number, address or relatives.

No. The law does not apply to sole proprietors’ debts from business activity or to debts governed by housing legislation and the laws on utility supply.

Professional collection agencies are not on the list of organisations in Article 5 of 115‑FZ. For them, identifying the debtor is a way to comply with 230‑FZ, not a requirement of the anti-money-laundering law.

A criminal record certificate is issued by the Ministry of Internal Affairs, and the candidate obtains it themselves. A check of criminal cases in courts of general jurisdiction is an additional signal, not a replacement for the certificate. Details are on the page on candidate checks.

Number and database checks — 5 ₽ each, sixteen basic checks — 50 ₽. A document with Liveness — from 29 ₽ per session. There is no subscription fee.
