Sanctions screening of counterparties for foreign trade and commodity trading: directors, representatives and beneficiaries before the contract and the payment

Check a foreign counterparty before the contract: its directors, representatives and known owners against the OFAC, EU, UK and UN lists, PEP and other countries' sanctions. A Russian counterparty is checked by INN and against the Rosfinmonitoring lists. You see the risk before the payment gets stuck in a bank.

The bank, Russian measures and foreign sanctions: the rules a foreign trade deal meets

A foreign trade payment passes through the resident's bank, correspondent banks and the counterparty's bank. The resident's bank works under currency legislation and Federal Law 115-FZ, the deal falls under Russian restrictive measures, and foreign banks follow the sanctions rules of their own countries.
NeuroVision checks people, the Russian company and documents before the contract and the payment. You decide on the deal; the bank decides whether to process the payment.

  • The resident's bank and currency control

Federal Law 173-FZ, arts 19 and 22; Bank of Russia Instruction 181-I; Federal Law 115-FZ, art. 7, para. 11.

    Why payments are delayed

    Currency control agent

    • The authorised bank monitors the currency transactions of its resident client
    • A contract for imports from RUB 3 million and for exports from RUB 10 million is registered with the bank

    Repatriation

    • An exporter must receive the proceeds in its account at an authorised bank within the period set by the contract
    • An importer must return the advance for goods that have not been imported into Russia

    Refusal of a transaction

    • The bank may refuse a transaction if its internal control rules give rise to suspicion
    • From the documents, the bank looks not only at the amount but also at the parties to the deal
  • Russian restrictive measures

    Presidential Decrees 79, 81, 95 (2022), 252 (2022), 520 and 618 (2022); Government Resolution 851.

    What to check

    Currency and settlements

    • A special procedure for selling foreign currency proceeds and restrictions on foreign-currency loans to non-residents — Decree 79
    • The procedure for settlements with creditors from unfriendly states through type C accounts — Decree 95

    Deals by permission

    • Certain deals with persons from unfriendly states — loans, credits, securities, real estate — require the permission of the Government Commission (Decree 81)
    • Deals with shares in limited liability companies and strategic companies — Decrees 618 and 520

    Outright ban

    • Deals with organisations on the list of countermeasures and persons they control are prohibited — Decree 252; the list is in Government Resolution 851
  • Foreign sanctions and secondary risk

OFAC: the 50% rule; US Executive Order 14114 (22 December 2023); Arbitrazh Procedure Code of Russia, art. 248.1.

    Choose the checks

    A risk, not an obligation

    • Russian law does not require you to check a counterparty against the OFAC, EU and UK lists
    • A match with them is a risk of a payment delay and of a refusal by a bank or a partner

    The 50% rule

    • Under the OFAC rule, a company is also treated as blocked if persons on the list own it in aggregate at 50% or more, even if the company itself is not on the list
    • That is why the check looks not only at the name but also at the people behind the company

    Correspondent banks

    • Since December 2023, the US may impose sanctions on foreign banks for significant transactions connected with the Russian military-industrial sector
    • Foreign banks have become stricter in checking the parties and documents of deals with Russia

Exporters, traders, foreign trade departments and B2B platforms: who should check a counterparty before payment

Each participant in the foreign trade chain has its own moment for the check: before the contract is signed, before the prepayment, before shipment or before admission to the platform. Your risk defines the set of checks — NeuroVision connects only those you need.

  • Exporters and importers

    • The director and signatory of a foreign buyer — against the OFAC, EU, UK and UN lists
    • PEP and negative media — before the prepayment
    • The representative's passport — without manual entry; Sanctions screening
  • Metal and scrap traders

    • Checking a metal buyer: a Russian one by INN, a foreign one through its people
    • The director of a Russian scrap seller — nominee status, bankruptcy, debts
    • The Rosfinmonitoring list for each party; Check by INN
  • Grain, coal and oil products

    • Intermediaries in the supply chain — every director and representative
    • International screening for other countries' sanctions
    • A repeat check when the payee changes; Foreign trade checks
  • Foreign trade departments, customs representatives and logistics companies

    • The client and its representative — before the clearance agreement
    • Passports of foreign drivers and representatives — recognition for 195+ countries and territories
    • The power of attorney and data — into the client record; Passport recognition
  • B2B commodity trading platforms

    • Admitting a participant to trading: the company by INN, the people against lists and sanctions
    • Foreign participants — international screening
    • A report for the participant's file; Due diligence
  • A trader's rolled metal warehouse before shipment

Sanctions check of a foreign counterparty: people, the Russian company and documents

The sanctions risk of a foreign company is most often visible through its people: who its director is, who signs the contract, who owns it. You submit the names from the contract and documents and receive an answer for each list, while a Russian counterparty is checked by INN alone.

  • Director and signatory of a foreign company

The name in Latin letters is matched against the OFAC, EU, UK and UN lists, taking aliases and spelling variants into account. For each match you get the list, the programme and the degree of similarity.

How a foreign trade department checks a counterparty with NeuroVision before signing the contract

The check fits between agreeing the terms and signing the contract, and is repeated before payment: data from documents, a query against lists and registers, a decision under your rules. Disputed matches go to a lawyer or compliance; clean ones move on through the process.

Step 1

Counterparty documents — from a photo or a scan

The representative's passport, the draft contract and the invoice are uploaded to the web account or sent via the API. The name in Latin letters is taken from the passport MRZ, the parties' details from the contract using your template, and anti-fraud checks the passport image.

Recognition of a foreign counterparty representative's passport and contract fields
Step 2

People and companies — in one request

The director, signatory and known owners — against the OFAC, EU, UK and UN lists and, where needed, PEP and other countries' sanctions. The Russian party — by INN: the Unified State Register of Legal Entities, signs of a shell company, the head, founders and the Rosfinmonitoring list.

A check of a foreign counterparty's people and a Russian company in one request
Step 3

A report before the contract and before payment

For each check — “passed”, “failed” or “not enough data”, the source and the records found. The report goes into the counterparty's file; before payment or when the payee changes, the request is repeated.

A report on a foreign and a Russian counterparty before signing the contract

Why a bank delays a payment under a foreign trade contract: four control points

Money under a foreign trade contract passes through several banks, and each may request documents or refuse. Most often the questions concern not the amount but the parties to the deal: who the counterparty's director is, who owns it and who receives the money. A counterparty check does not guarantee that the payment will go through — but it shows the risk before you ship the goods or send the prepayment.

  • The resident's bank

Matches the transaction against the registered contract and the internal control rules under Federal Law 115-FZ. If a party to the deal raises suspicion, the bank may refuse the transaction, and if there is a match with the Rosfinmonitoring list, it must freeze the funds.

  • The correspondent bank

Works under the sanctions rules of its own country and its partners. Since late 2023, foreign banks risk being sanctioned by the US themselves for transactions connected with Russia's military-industrial sector, and they check the parties to deals more strictly.

  • The counterparty's bank

Checks its own client and the sender: a director or owner matching a sanctions list, a change of payee to a third party, or a mismatch between the invoice and the contract is grounds for requesting documents.

  • Returns and deadlines

A delayed or returned payment does not release the resident from the obligation to receive the proceeds or return the advance within the period set by the contract. A check before the contract costs less than explanations to the bank afterwards.

Checklist before a contract and a payment abroad: eight steps to check a counterparty

  • The representative's passport — recognised from a photo, the name in Latin letters from the MRZ NeuroVision
  • The signatory's authority — a power of attorney or a document on the director Company

  • Beneficial owners — from the counterparty's statement, its documents or the bank Company
  • The named owners — against the same lists as the director NeuroVision
  • A 50% or higher share held by persons on lists — a risk sign under the OFAC rule Company

  • Whether the counterparty's country is on the list of unfriendly states and whether the Government Commission's permission is needed Company
  • The counterparty or its owner is on the list of countermeasures (Government Resolution 851) Company

  • Licences and export control for the goods, documents of title to the scrap Company

Frequently asked questions about sanctions screening of foreign trade counterparties

Check the people behind the company: the director, the contract signatory and known owners — against the OFAC, EU, UK and UN lists and, for partners from different countries, also against PEP, other countries' sanctions and negative media. In NeuroVision this is one request; the name in Latin letters can be taken from the recognised passport of the representative.

No. Russian law does not require it. Checking against foreign lists is an assessment of the risk of a payment delay and of a refusal by a bank or a partner, not compliance with foreign sanctions. The company decides on the deal itself under Russian law.

The basic sanctions check is designed for people: directors, representatives, owners. Under the OFAC rule, a company is also treated as blocked if persons on a list own it at 50% or more, so checking the people behind the company is the key step. We will discuss a check of the company by name and links under the 50% rule for your task.

The resident's bank matches the transaction against the contract and the internal control rules and may refuse if it has suspicions. Foreign correspondent banks work under the sanctions rules of their countries and, since late 2023, risk being sanctioned by the US themselves, so they check the parties to the deal more strictly. Most often the questions concern the director, the owners and the recipient of the money.

A Russian buyer or seller — by INN: status in the Unified State Register of Legal Entities, signs of a shell company, the head and founders, their bankruptcy, debts and the Rosfinmonitoring list. A foreign one — through its people: the director, signatory and known owners against sanctions lists and PEP. You check the licence for scrap handling and the documents of title to it yourself — NeuroVision has no such checks.

Among the organisations named in Article 5 of Federal Law 115-FZ are those that buy and sell precious metals and stones, jewellery and their scrap. Trading in ferrous and non-ferrous metals is not on that list. But the payment still passes through a bank, which applies Federal Law 115-FZ to its client.

Those named by the counterparty or the bank — yes: against the same sanctions lists and PEP as the directors. Establishing owners from foreign legal entity registers is in the KYB platform's early access.

No. Vessels, route, origin of goods, foreign trade commodity codes, export control and licences are not part of the product. NeuroVision checks people, Russian companies and documents.

By INN: status in the Unified State Register of Legal Entities or of Individual Entrepreneurs, signs of a shell company, courts and debts, the head and founders — in one request. The people behind the company are checked by INN with no namesakes: bankruptcy, tax debts, the Rosfinmonitoring list and sanctions.

Passports are recognised with ready-made templates — 195+ countries and territories. Contracts, invoices and other deal documents — by the template of your forms: the parties' details, amounts and dates are extracted into JSON. The template is configured for your documents.

No. Each bank in the chain decides on a payment under its own rules. The check shows the risk on the counterparty's side before the contract and the prepayment, and the report helps you answer a bank's request faster.

Sanctions lists — RUB 5 per check, international screening for PEP and other countries' sanctions — RUB 36, checks of the people behind a Russian company — RUB 5 per register, a company by INN — on request. Passport recognition — from RUB 16 per session. Test access — 1 month.
